These Terms apply to all visitors, users, patients, and others who access the Site.
1. Website Use
The content provided on this Site is for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. Use of this Site does not establish a provider-patient relationship.
You must be at least 18 years old to use this Site or submit information through it.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only.

4. E-Prescribing Subscription Service
Specialists In Pain Care offers electronic prescribing (“e-prescribing”) as an optional convenience and security service for eligible patients. E-prescribing services are not covered by insurance and are not available to patients enrolled in Medicare or Medicaid plans.
The e-prescribing subscription fee is $50.00 every six (6) months and will be automatically charged on a recurring basis unless canceled by the patient.
By enrolling in the e-prescribing service, you authorize Specialists In Pain Care to charge the recurring subscription fee using the payment method provided. All subscription fees are non-refundable, including partial subscription periods, unused services, or failure to cancel prior to renewal.
It is the patient’s responsibility to notify our office if they wish to cancel their subscription. Failure to request cancellation will not stop recurring billing and does not qualify the patient for a refund.
We reserve the right to modify, suspend, or discontinue the e-prescribing service at any time.
5. Privacy and HIPAA
Your use of this Site is also governed by our Privacy Policy. Any protected health information submitted through patient forms or portals will be handled in accordance with applicable federal and state privacy laws, including HIPAA where applicable.
While we take reasonable security measures, no internet transmission is completely secure, and we cannot guarantee absolute security of electronic communications.
6. SMS/Text Messaging Consent
By providing your phone number to Specialists In Pain Care, you consent to receive appointment reminders, billing notifications, office updates, and other healthcare-related communications via text message.
Message and data rates may apply. Message frequency may vary.
You may opt out of text communications at any time by replying STOP or by contacting our office directly.
Consent to receive text messages is not a condition of receiving medical treatment.
7. Payments and Refunds
Unless otherwise stated in writing, all fees paid to Specialists In Pain Care for administrative services, subscriptions, forms, or convenience services are non-refundable.
Patients are responsible for understanding any recurring charges associated with optional services prior to enrollment.
8. Third-Party Links
This Site may contain links to third-party websites or services. These links are provided solely for convenience. Specialists In Pain Care does not control or endorse third-party websites and is not responsible for their content, policies, or practices.
Your use of third-party websites is at your own risk.
9. Intellectual Property
All content on this Site, including text, graphics, logos, icons, images, and software, is the property of Specialists In Pain Care or its licensors and is protected by copyright, trademark, and intellectual property laws.

To the fullest extent permitted by law, Specialists In Pain Care shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site.
Your sole remedy for dissatisfaction with the Site is to discontinue use of the Site.
12. Arbitration and Dispute Resolution
Any dispute arising out of or relating to these Terms or use of the Site shall first be attempted to be resolved informally.
If a dispute cannot be resolved informally, it shall be resolved through binding arbitration in the Commonwealth of Kentucky in accordance with the rules of the American Arbitration Association.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
Nothing in this section prevents either party from seeking relief in small claims court where permitted by law.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to conflict of law principles.
Any legal proceedings not subject to arbitration shall be brought exclusively in courts located in Kentucky.

We reserve the right to modify these Terms at any time. Updated versions will be posted on this page with a revised effective date.
Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
